According to Max Brod, Kafka did not leave an official will. Among the papers in his desk, a small note was found written in ink and addressed to Brod. Then another sheet, written in pencil, was found. Since it refers to the short story “The Hunger Man,” which Kafka wrote in the spring of 1922, this “testament” can presumably be dated to 1922. Both notes were published by Brod in his afterword to the novel “The Trial.”
